The purpose of a prior art search is to find all pre-disclosed information relating to an invention for the purpose of demonstrating patentability. A patent application will be compared to the prior art to determine whether it describes a novel invention and whether or not a patent should be granted. This search is always performed prior to patent issuance.

The purpose of a freedom to operate search is to obtain information as to whether a product, process, or service infringes upon any patent(s) owned by others. It starts with a search for issued or pending patents similar to the invention at hand. A detailed comparison is then performed to assess whether or not the invention at hand is described in any of these similar patents or applications.

The purpose of patent due diligence searching is to assess a patent’s business value. Specifically, a patent’s depth, future potential, ownership, scope, and enforceability are assessed. Patent due diligence searches are typically conducted by potential licensees prior to entering a licensing agreement or by a potential licensor to help articulate the value of the invention.

The purpose of a trademark search is to determine whether a given trademark is already being used in commerce. Trademark searches start with a search for the same or similar trademarks in the same field and then typically expand to include related fields. This search should be performed as soon as the idea for a trademark is developed as branding typically revolves around the company’s trademark.
